2009 Model Year Genesis Trailer Warranty

8.1 3 Year Hitch to Bumper Coverage
This Kiefer Built, LLC warranty includes 3-year hitch to bumper coverage on all Genesis models. The 3-year warranty period begins on the date of original purchase. In addition, the roof is warranted as leak-proof for the 3-year period. Some exclusions do apply to this 3-year hitch to bumper warranty and those exclusions are detailed in section 8.7 below.

8.2 8 Year Structural Coverage
Kiefer Built LLC expressly warrants to you, the original purchaser of a Kiefer Built Genesis trailer, that on the date of purchase by you, the product was free from defects in the composition of material and workmanship. This 8-year structural warranty covers the main trailer structure, consisting of the side rails, floor cross members, hitch, gooseneck and axle sub frames. Items such as doors, windows, ramps, stall dividers, flooring, and axles are not included in the 8-year structural warranty. Further exclusions do apply to this 8-year structural warranty and those exclusions are detailed in section 8.7 below.

8.3 Warranty Duration and Notice Requirements
This warranty shall remain in effect for a period of eight (8) years for structural defects, three (3) years Hitch to Bumper, from the date of sale to the original purchaser. This warranty shall not extend beyond that warranty period.

The original purchaser must provide an authorized Kiefer Built Dealer prompt notice of all defects. Upon receipt of such notice, the dealer shall promptly and without undue delay notify the original purchaser of their intentions and preferences to effect repair of the trailer. Kiefer Built suggests that the original purchaser take the trailer to the dealer where it was purchased, however, any authorized Kiefer Built dealer can perform work on the trailer. There is an approval process for repairs; therefore, any repair costs incurred by the original purchaser prior to notification of an authorized Kiefer Built Dealer may not be covered.

8.4 Warranty Transfer
The basic warranty is transferable (with a paid transfer fee) to a subsequent owner for the remaining duration of the warranty period, 3-years hitch to bumper or 8-years structural, from the original purchase date. Warranty transfer forms are available from, and must be filled out by, an authorized Kiefer Built Dealer prior to the sale to the second owner.

8.5 Remedies Available From Kiefer Built
In the event of a defect in material or workmanship covered by this warranty, Kiefer Built at its sole discretion will:

Correct the defective work or replace the defective part on a no-charge basis.

Reimburse the original purchaser by paying a sum not exceeding the price charged by Kiefer Built for such work.

Kiefer Built may, at its option, require the defective part or trailer to be returned to the plant for repairs. Any transportation costs to, or from, the dealer, factory or service center for the purpose of inspection or repair of the trailer are the sole responsibility of the trailer owner.

8.6 Remedies Not Available From Kiefer Built
The obligations stated in the preceding paragraph are sole exclusive remedies available from Kiefer Built, in the event a challenge to the warranty should occur. Kiefer Built will not be liable for any special, incidental, or consequential damages. Kiefer Built reserves the right to make changes in design or make additions and/or improvements to its product without being obligated to make similar installations or modifications to products covered by the warranty.

8.7 What Is Not Covered By This Warranty
The following are not covered by this warranty:

Transportation costs to, or from, the dealer, factory or service center for the purpose of inspection or repair of the trailer are the sole responsibility of the trailer owner
Tires – Any claim on tires must be presented to the tire manufacturer
Chipping of paint or coatings
Normal deterioration due to wear of items such as, but not limited to, sealants, caulking, vinyl, paint, graphics, brakes, brake linings, bearings, hoses, batteries etc.
Modifications, additions, or accessories (not manufactured by Kiefer Built) added to the trailer after the trailer was shipped from a Kiefer Built manufacturing plant
Damage or loss caused, in whole or in part, by failure to follow or adhere to recommended use and care of the trailer
Damage or loss caused, in whole or in part, by the failure to clean animal excretions from the trailer
Damage or loss caused, in whole or in part, by animals or other cargo transported in the trailer
Damage or loss caused, in whole or in part, by using the trailer for commercial purposes
Damage or loss caused, in whole or in part, by failure to check and torque lug nuts properly
Damage or loss caused, in whole or in part, by accident, negligence, abuse, misapplication or misuse of the trailer or any of its component parts
Damage or loss caused, in whole or in part, by exceeding the GCWR (Gross Combined Weight Rating) of the tow vehicle – includes the combined weight of the tow vehicle, trailer, cargo and passengers
Damage or loss caused, in whole or in part, by prolonged exposure to salt air, road salt, animal excretions, acid rain, industrial fallout, or acts of God or nature that are uncontrollable
Injuries sustained by, or to, animals or any damage to other items carried in the trailer
Any consequential or incidental damages incurred as a result of any defect, including, but not limited to, loss of time, inconvenience, loss of use of vehicle, incidental damage to animals, trailer, or property, or any fees incurred by the original purchaser relating to a warranty claim

8.8 What Will Void This Warranty
Misuse of the trailer, commercial use of the trailer, structural alterations made to the trailer, overloading the trailer, failure to perform normal maintenance to the trailer, and/or performing unauthorized repairs to the trailer will void this warranty.

8.9 No Other Warranties
THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN THE ORIGINAL PURCHASER AND KIEFER BUILT LLC, CONCERNING THE ALLOCATION OF THE RISKS OF DAMAGE OR LOSS ARISING FROM COMPONENT DEFECTS. THIS WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS, AND NO ONE IS AUTHORIZED TO TAKE ANY FURTHER ADDITIONAL WARRANTIES ON BEHALF OF KIEFER BUILT, LLC. THIS AGREEMENT ALLOCATED THE RISKS OF DAMAGE OR LOSS ARISING FROM PRODUCT DEFECTS BETWEEN KIEFER BUILT, LLC AND THE ORIGINAL PURCHASER, AND BOTH PARTIES RECOGNIZE THIS ALLOCATION.
