Kiefer Built Inc., Custom Horse and Livestock Trailers

9.1 Structural Coverage
Kiefer Built LLC expressly warrants to you, the original purchaser of a Kiefer Built trailer, that on the date of purchase by you, the product was free from defects in the composition of material and workmanship. This warranty covers the main trailer structure, consisting of the side rails, floor cross members, and sub frame to which axles are attached.

9.2 Warranty Duration and Notice Requirements
For Kiefer Built trailers this warranty shall remain in effect for the period noted below, by model, for defects after the date of sale to the original purchaser. This warranty shall not extend beyond that warranty period.

6 Year Structural Coverage on Deluxe II & Advantage trailers
3 Year Structural Coverage on EXLA, Grand Prix, Evolution and Kargo.
1 Year components Coverage on EXLA, Grand Prix, Evolution and Kargo.
90 Day Structural Coverage on commercial use trailers, regardless of model
1 Year Leakage Coverage in dressing room only (excludes Stockman & Advantage)
90 Day Paint Coverage against peeling or fading

Buyer shall give Kiefer Built prompt notice of all defects. Buyer should notify either an authorized Kiefer Built Dealer or Kiefer Built LLC of any warranty problems. Upon receipt of such notice, Kiefer Built or the dealer shall promptly and without undue delay notify buyer of its intentions and preferences to effect repair of the trailer. Kiefer Built suggests that you take the trailer to the dealer where you purchased it, however, any authorized Kiefer Built dealer can work on your trailer.

9.3 Warranty Transfer
The basic warranty is nontransferable.

9.4 Remedies Available From Kiefer Built
In the event of a defect in material or workmanship covered by this warranty, Kiefer Built at its sole discretion will:

Correct the defective work or replace the defective part on a no-charge basis.

Reimburse the original purchaser by paying a sum not exceeding the price charged by Kiefer Built for such work.

Kiefer Built may, at its option, require the defective part or trailer to be returned to the plant for repairs. All transportation charges in connection with a warranty claim will be the sole responsibility of the trailer owner.

9.5 Remedies Not Available From Kiefer Built
The obligations stated in the preceding paragraph are sole exclusive remedies available from Kiefer Built, in the event a challenge to the warranty should occur. Kiefer Built will not be liable for any special, incidental, or consequential damages based upon breach of contract, negligence, strict liability in tort, or any other legal theory. Kiefer Built reserves the right to make changes in design or make additions and/or improvements to its product without being obligated to make similar installations or modifications to products covered by the warranty.

9.6 What Is Not Covered By This Warranty
Items not manufactured by Kiefer Built, including, but not limited to, assembled axles, windows, coupler, jack, wheels, hinges and trim. If and to the extent these items are warranted by the manufacturer or supplier thereof, Kiefer Built will extend such warranties to the purchaser.

Tires. Any claim on tires must be presented to the tire manufacturer’s representative.

Paint chipping.

Normal wear items including, but not limited to, roof sealant, caulking, vinyl, paint, graphics, brakes, brake linings, bearings, hoses, etc.

Modifications, additions or accessories (not manufactured by Kiefer Built) added to the trailer after the trailer has shipped from a Kiefer Built manufacturing plant.

Damage or loss caused, in whole or part, by failure to check and torque lug nuts properly.

Damage or loss caused, in whole or in part, by accident or negligence or by the abuse, misapplication or misuse of the trailer or any of its component parts.

Any transportation charge to or from factory or service center.

Damage or loss caused in whole or in part by prolonged exposure to salt air, road salt, animal excretions, acid rain, industrial fallout, or acts of God or nature that are uncontrollable.

Any consequential or incidental damages based upon breach of contract, negligence, strict liability in tort, or any other legal theory, incurred as a result of any defect, to include loss of time, inconvenience, loss of use of vehicle, or any fees incurred by purchaser relating to a warranty claim.

9.7 What Will Void This Warranty
Misuse, animal damage, neglect, overloading, unauthorized repairs, alterations, or failure to provide normal maintenance shall void this warranty.

9.8 No Other Warranties
THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN YOU AND KIEFER BUILT LLC, CONCERNING THE ALLOCATION OF THE RISKS OF DAMAGE OR LOSS ARISING FROM COMPONENT DEFECTS. THIS WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS, AND NO ONE IS AUTHORIZED TO TAKE ANY FURTHER ADDITIONAL WARRANTIES ON BEHALF OF KIEFER BUILT LLC. THIS AGREEMENT ALLOCATED THE RISKS OF DAMAGE OR LOSS ARISING FROM PRODUCT DEFECTS BETWEEN KIEFER BUILT LLC AND PURCHASER, AND BOTH PARTIES RECOGNIZE THIS ALLOCATION.
